Terms of Service

1. Service Description

Axiom Refract ("the Service") is an enterprise code analysis platform operated by Axiom Refract ("we," "us," or "our"). The Service provides automated codebase analysis including architectural health scoring, single point of failure (SPOF) detection, dead code analysis, dependency visualization, compliance framework reporting, and AI-powered insights via the Model Context Protocol (MCP).

By accessing or using the Service, you ("you" or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload malicious code, malware, or code designed to exploit or damage systems.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service itself.
• Use the Service to analyze code you do not have the legal right to analyze.
• Share or redistribute analysis reports containing proprietary code of third parties without authorization.
• Circumvent rate limits, authentication mechanisms, or access controls.
• Use automated scripts or bots to access the Service outside of approved API integrations.
• Interfere with or disrupt the Service infrastructure or other users' access.

3. Accounts and Authentication

Some features of the Service require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk.

4. Intellectual Property

Your Code: You retain all ownership rights to the source code you upload to the Service. We do not claim any intellectual property rights over your code. Your code is analyzed solely for the purpose of generating your analysis report and is handled in accordance with our Data Handling Policy.

Our Service: The Service, including its software, design, documentation, analysis algorithms, and reports (excluding your code content), is owned by Axiom Refract and protected by intellectual property laws. Your use of the Service does not grant you any ownership rights in the Service itself.

Analysis Reports: Reports generated by the Service based on your code are provided to you for your use. You may share, distribute, or publish your own reports as you see fit.

5. Service Tiers and Payment

The Service is offered in multiple tiers: Free, Starter, Startup, Team, Business, and Enterprise. Features and usage limits vary by tier as described on our Pricing page. Paid tiers are billed monthly or annually as selected at the time of subscription.

5.1 Payment Processing

All payment processing is handled by Stripe, Inc., a PCI-DSS Level 1 certified payment processor. When you subscribe or make a purchase, you are redirected to Stripe's secure hosted checkout page. We do not store credit card numbers, CVVs, bank account credentials, or any other payment instrument details on our servers. We receive only your billing name, billing address, last four digits of your card, card brand, and transaction amounts from Stripe for record-keeping purposes.

5.2 Billing Cycle

Subscriptions automatically renew at the end of each billing period (monthly or annually) at the then-current rate for your plan. You may cancel your subscription at any time before the next renewal date. Cancellation takes effect at the end of the current billing period — you retain full access to paid features until then.

5.3 Refund Policy

We do not offer refunds for partial billing periods. When you cancel a subscription, you keep full access to your plan through the end of the current billing period. Pay-per-scan purchases are non-refundable once analysis processing has begun. Founder pricing is locked for life and applies only to the original subscriber.

5.4 Payment Failures

If a payment fails, Stripe will automatically retry the charge according to its retry schedule. We will notify you of any payment issues. If payment cannot be collected after multiple attempts, your subscription may be suspended until payment is resolved. You can update your payment method at any time through the Stripe Customer Portal, accessible from your Admin panel.

We reserve the right to modify pricing with 30 days' notice. Existing subscriptions will be honored at their current rate until the end of the current billing period.

5.5 Free Tier

The Free tier includes 1 analysis run on public repositories. Additional runs may be earned by submitting social proof (a public social media post mentioning Axiom Refract). Each approved social proof submission grants 1 additional scan code, redeemable for 1 analysis run. The maximum number of social proof codes available varies by platform phase:

• Alpha (first 30 days after launch): up to 20 codes
• Beta (days 31–90): up to 10 codes
• Production (day 90+): 1 code per 30-day period

Free-tier analysis runs are processed on a best-effort basis. Paying customers — including Academic ($5/scan) and Press ($50/scan) tiers — are always prioritized in the processing queue. Free-tier users may experience longer wait times during periods of high demand.

We reserve the right to modify free-tier limits, phase durations, and social proof requirements at any time without prior notice.

6. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that analysis results will be complete or accurate in all cases.

Analysis reports are informational tools to assist your engineering decisions. They are not a substitute for professional code review, security auditing, or compliance certification. You are responsible for verifying findings and making your own engineering judgments.

To the maximum extent permitted by law, our total liability for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

7. Termination

You may terminate your account at any time by contacting us or using the account settings. Upon termination, your analysis data will be deleted in accordance with our Data Handling Policy.

We may terminate or suspend your access to the Service immediately, without prior notice, if you breach these Terms or if we determine that your use poses a risk to the Service or other users.

8. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless you are entitled to bring claims in small claims court.
